But I bet he would fall nicely in to IR35 if he is talking salary etc etc. Smacks of disguised employee so LTD may not be the best option. Could be an umbrella will work better. You could try and convince yourself by wording the contract but seems you are talking a salary and support etc I doubt it would fly.
Dunno about the employment law stuff but could you not get a Euro account and cash in as the Euro gets better? </takes spekulant hat off>

Another option is to establish a UK branch of the German company and set up back office facilities such a payroll e.t.c and pay myself under PAYE - obviously as the company grows this will need to be done in the long run anyway. The directors are flexible as to which approach we take thus i thought it would be worth running it through here to get the general view on which direction to take.
Such a setup also ensures you are covered by UK employment law.Last edited by Clippy; 3 September 2010, 13:58.

Job offer with a difference!
Hi all,
I have recently been offered a position with a Germany company to be based and work within the UK. Alongside working with UK clients there will also be frequent travel to overseas clients in Europe and possibly further however I will always be returning to the UK at weekends.
The company doesn't currently have an office in the UK thus no back office support facilities exist to deal with payroll e.t.c.
We have agreed a gross yearly salary, number of days paid leave, bonus, benefits e.t.c and they have asked how i would like this to be paid. My initial thinking is to establish a UK LTD and bill both time and re-billable expenses on a monthly basis back to the company in Germany, taking the minimum wage and paying the rest in dividends.
Another option is to establish a UK branch of the German company and set up back office facilities such a payroll e.t.c and pay myself under PAYE - obviously as the company grows this will need to be done in the long run anyway. Thanks in advance for the replies.Tags: None
