It appears not to be a dumb question after all!
I did try for about half an hour to search the forums but couldnt find these links anywhere. They are both quite old...
I know I'm late but I'm filing on the Employer CD -ROM from HMRC. As I understand it they had so many problems with it this year that they are giving a 10 day extension to the deadline.

Funny. Sure this has been asked/answered lots of times including very recently when most people filled in their returns (bit late ain't ya?) but darned if I can find it.
go to Shout 99 and type "service company question", search seems to work much better than it does on here.

PAYE Employer annual return
Sorry if this is a dumb question but just completing the PAYE employer annual return and I've got to the Check list 6.
Am I a service company? I'm a contractor who is providing a service to a client and under their description I think I am but my contracts and operations have been outside of IR35. So what should I tick here Yes I'm a service company or no I'm not. If 'Yes' to question 6, have you operated the Intermediaries legislation (sometimes known as IR35) or the Managed Service Companies legislation? I guess that is a no...
I really dont want to get this wrong so can someone please advise.
