    IR20 and Non residency

I assuming you have the new IR20 there were quite a few new changes this fiscal year.

The answer to your question is probably a bit more complicated and would depend on the details of your circumstances, feel free to PM me if you wish and I can give you a good idea. ( Some fo the rules to be applied will be dependent on where you are tax domiciled, if you have left the uk previously for tax purposes etc.....)

Generally speaking if you are in the UK for 183 days or more, you will be taxable in the uk that year.

If you have left the uk for tax purposes you need to not return for more than 90 nights on average over 5 years to maintain non taxable status.

Also generally, if you are taxable in one tax year then you are taxable on all income in that tax year, although under some circumstances it is possible to split a tax year.

It also depends where you go.....you could become taxable in the other jurisdiction, which could be worse !

started a topic Non Resident Question

    Non Resident Question

I initially thought one of the rules to be classed as non resident was not to be in the UK for a full tax year. In the more detailed Hector IR20 document it also states employment must last for a full tax year.

What would happen if a contract ended before the tax year but the rainy day fund could cover a period on a sunbed style bench outside of the UK ?

The example quoted seems a bit lax as it states if one employment ends and you return to the UK for a short period of time then go abroad again then HMRC would re-assess the non residency status. What if you just don't go back to the UK until well after the end of the tax year ?

    Any advise appreciated.
