I knew you didn't say that just wanted to make clear I was commenting on the same topic.

Won't necessarily mean a thing. What eek means is that say you're with Venn Group at the moment, get this work package based one through a different agency. Or get an entirely different PS gig with a different agency - anything to ringfence the current gig. Where eek is coming from stems from a thread on here from the last couple of weeks. The surmising from that was that if you continue with the same agent and client into April, you're leaving yourself open to a retrospective tax grab by HMRC which IR35 insurance probably won't protect.

I don't think its the previous contracts you need to worry about, its your current contract especially if its going to continue beyond April that I would be concerned about...

I have just spoken to QDOS and they don't seem to be concerned, if one day i am outside IR35 and the next i'm inside, based on a new contract... I think they (QDOS) feel confident that any public sector that is risk adverse, will simple say everyone inside ir35... I of course wont agree but will "swallow" just to earn money... So if push came to shove (IR35 investigation) QDOS would fight the above.

Hi all,

I work for a rather big HE, they have just released a statement saying "work package" based contracts maybe supported, which will allow the continuing use of limited companies...

I am working on a large 2 year program, payed by an external public sector body...

Hss any one heard this "work package" term yet? and does it hold any water?

The concept of a Work Package is fairly standard in project-based work, particularly in Europe and the PS (e.g. it's formalised in all EU projects). It's basically the disaggregation of a project into component parts, each of which may contain one or more milestones and deliverables. It's an administrative unit, defined in whatever way makes sense for a particular project. It has nothing to do with payment terms.

Yeah I asked the same question and got the exact same response. Plus the supply chain is quite complex as well which is why it is hard to try and make anything stick.

You presume they would fight the above.

Regardless you really don't want an investigation due to the stress you will be but under.

Where do you get the idea that a new contract is coming, that's an assumption that may or may not be valid?

Equally given that you are now inside, whilst QDOS may be willing to fight for you the battle will be different from what they've had to fight before... Have they successfully won cases in the past where a contract moves from outside to inside due to decisions made by the end client? some how I doubt it....
