    Early Days

    • It is DonkeyRhubarb's opinion (and DR has been in HMRC's face for a long time now) that it will be quite some time before appeals hit the tribunals - there are 20,000+ individuals being approached. Given Hectors talents it will take 2 years just to put those in alphabetical order.
    • HMRC have investigated at least one former Edge employee (see earlier in this thread) and dropped the case after 3 years.
    • Based on this, the whole affair could just be a fishing exercise to get some people to pay the demands. Those who appeal may find their files sitting in the 'too hard basket' for a long time.
    • If this does hit the tribunals, we don't know how it will proceed. 20,000 seperate cases or test cases per provider?
    • Edge can't make any commitment until the above is decided.

For now I think we concentrate on getting appeals in, supporting each other through what will be a stressful time and keeping our ears open.

I agree that these are early days and we may not need to pool the funds right away. The important thing is to stick together and have an action plan to execute if things don't go in our favour.

I've sent off my 'appeal' and not yet received a reply from HMRC.

The Post Office portal tells me my registered delivery letter has been received.

Do I assume like others that the reply is caught up in the paperwork they are creating for themselves or do I sent another one ? – I'm not even contemplating calling them.

Like others on here I'm happy to contribute serious cash to a group fighting this.

I think we're well off that point however.

I just plan to sit tight and see where we go next – the next move is HMRC's.

      To me it all seems pretty pointless as we all know we haven't done anything wrong – and HMRC should be in no doubt that we will appeal and appeal and appeal again against their decisions in the knowledge that even if they win we all have a simple exit strategy;

Another Edge EBT / Tax Demand question

As yet another IT consultant who worked with via Edge in 2008/2009 can I say how re-assuring the updates in this thread have been to me in, at least, knowing I am not alone!

Anyway - I had a question that I am hoping someone can help answer - I received a HRMC Self-Assessment Statement today with a large amount shown as 'owed'. I only received the statement and no associated letter from HMRC - do I send my appeal letter to the address (which is the Self-Assessment PB Box in Newcastle) or to the Bedford address mentioned in earleir threads - or can I expect a letter as well?

          thanks!

            Same happeded to me: ???

            1. Phone them up ask what its about.
            2. Send a letter immediatley disagreeing with the SA amount and mention the details of your call and send it recorded.

            3. Wait for the letter you shoud have got and respond like everyone else

Spoke to somebody at the HMRC office – they confirmed they have received my appeal.

I was asked which scheme my appeal related to – so they are clearly dividing things up per scheme.

I was told that there was a 2 week backlog of work required to process appeal responses – whether that was in total or just related to Edge wasn't clear.

No idea if this is of interest to anybody else but that seems to be where we all are at the moment.

I was with edge during the 08/09 tax year but i haven't had a letter through. Is anyone else in the same position? Is there a way of checking if I should have had a letter but it was lost in the post? I had a HMRC statement through in Feb which didn't mention any amounts owed.

Group advice and representation 'EDGE Only'

                    Hi All,

I have been in contact with a reputable tax adviser and barrister who specialises in this area. As we are probably all aware this is very early days and it has been said numerous times on this forum that good independent advise is a must. It goes without saying that good advice doesn't come cheap, and should any litigation be required then the costs can quickly mount up (let's hope that's not required).

A number of people have intimated clearly that they would be inclined to join a group, and this appears a sensible approach to take and certainly worthy of investigation as to how this would work in practice.

The adviser has outlined how such a group undertaking would normally be managed, and provided indicative costs and timescales for all potential stages (including worse case scenarios).

The next step is to gauge genuine interest in forming a group.

There ideally needs to be a minimum of 25 to 30 people to even consider getting past the first post. Clearly the more people the better. If you are interested then I would be grateful if you can send me a PM. I will gauge interest over the next 4 weeks. If the numbers are not met then I won't pursue it any further and will notify respondents. If there is genuine interest then I'll move things forward in a more structured way.

There is no commitment at this point other than expressing an interest. We have to start somewhere!

Like everyone else I am very busy and organising this isn't my core way of making a living. So I must emphasise I would just like to get initial interest. I am sure you will want to ask questions at this point but it is just not feasible at this stage to start replying in detail to individuals. If there is sufficient traction I'll correspond on a group basis in order to minimise my admin time. I hope you understand.

Best of luck however you handle things.

Thanks so much for doing this. I will update the first post in this thread with regards to this as well.
