    APN on its way

    Couldn't have picked a more miserable Monday morning weather wise to receive the brown envelope warning of imminent APN for 2009-10.

    So I await AML pursuing a tribual now as they promised.

      My Update

      Hi All,

      Just thought i would leave an update from the other side e.g. I agreed to settle.

      It has been long and drawn out, have various letters from different departments of HMRC. It does not appear they have any idea what is going on. Even though I agreed to settle, they still sent me an APN because they didn't realise another department had my settlement.

      HMRC have now asked for me to sign and send back a form that has a statement confirming that I will take no further action - pretty much saying evening if they are wrong, I'm not getting the money back.

      I took independant advice and it is the best thing I have done (above query still to be questioned). Yes, it costs but could save you a bit also as they confirmed HMRC had mis-calculated the apparent tax owed - this turned out to be a considerable amount!!

      I am not holding my breath with AML, I truly believe they will fight the first so far then set up shop if it gets too expensive for them, which it will because can't see HMRC giving up either! This is my view, not anyone else's.

        Have they confirmed no IHT will be added at some point in the future? They warned me that I could still owe further amounts even if settling.

        Therefore the only benefit of settling now is to avoid NI and further interest? (unless there is a tax miscalculation as seems to have been in your case)

        Let me know if I am wrong as the deadline is very close and I would also love to end this now if I could.

          Hi Confused, I must admit I'm not sure which way to turn here as well; AML are providing little in the way of information and/or obvious support. I would like to fight on, especially as HMRC are very hypocritical in the way they apply rules (not to mention they have asked you to sign a letter, but gave no such assurances). However, as I have just received another threatening letter from HMRC I would also like to explore closing this out. Would you be happy to provide any more information on your settlement? Did your settlement cover 1 or a number of years? Any idea how they calculated the amount owed? Would you recommend your advisor? If you don't want to post, could you pm me. Much appreciated.

            Just had my HMRC reminder letter through today letting me know I need to pay my APN by 23rd June.

            I hope AML get the JR sorted in time before then, as i can't afford to pay it!

            Did someone say that I can get an extra 30 days if I question the amounts? Would I just write a letter asking them to recalculate the amounts?

              You have until the end of June to settle with them however.

              On a few notes from above, the legal advice I got was pretty generic but it put my mind at ease knowing that HMRC weren't going to chance there arm even more. Imagine there are a number of tax specialist solicitors out there. My settlement was for 2 different tax years, however worked out to be about 14/15 months. HMRC initially tried to claim 50% tax on pretty much all of it but it was recalculated by my solicitor to which HMRC somewhat agreed - £minimal here or there.

              Has anyone had any other tax queries through i.e Tax years post EBT? Partnership agreements?!

                  Not an extra 30 days.

                  If you make a valid representation, HMRC must consider it. there is no time limit for this. If they then write to you and say "it's good or it's amended" you have 30 days from that letter to pay assuming it's later than the original date.

                  You need a reason for them to recalculate. incorrect information? Incorrect tax rates?

                  The representation also needs to be compliant with the law. We already know that some such letters have been rejected as not being compliant.

                  If in doubt - get professional advice because it's unbiased and objective.

                    I have for 2011-12 & 2012-13. AML have not replied to numerous emails I have sent them. Really don't know where i stand as they have been in perpetual dialogue with HMRC for months

                      I am in a similar position to you. AML stated they are in dialogue with HMRC to respond on our behalf as opposed to answering the 30 odd questions on the Section 9A request.
