Hi looking for a bit of advice. I used Smartpay for 2 years 2016/2017. I have received a self assessment request from HMRC. I have contacted Smartpay re the loans and they told me not to declare them as income. However I've seen lots of publicity about these loans and want yo stay on the right side of the law! I'm new to all this and don't know what to do. Any help would be gratefully received.

Whether or not they go on the SAR, they will be caught by the loan charge as the law now stands. Maybe HMRC will never find out about the loans? If they do, and you did not declare, you are in SERIOUS trouble. The fact that you posted here means you are probably worried.
You need to get out of the scheme NOW.
You need independent professional advice. Some use an accountant, most use specialists. I use Phil@DWS - others use WTT.
It is quite rare for the scheme provider to still be around - that may be helpful.
Have you tried searching for smartpay on these forums? https://forums.contractoruk.com/hmrc...-smartpay.html is one example of results. -
Don’t take any advice from smartpay they are dishonest crooks, seek independent advice as green mirror has said.Comment
