    It actually was an error in the original bill that became Finance Act 2017 and the amendment (originally in para 44 Schedule 17) recognised that the same sub-section was also being amended by the same bill (it specifically refers to the amendment being made by para 4 Schedule 16). My guess is that someone tweaked the wording of what was originally in para 4 of Schedule 16 before the bill was first published but did not then make a consequential adjustment to what was then para 44 of Schedule 17. Then when the next Finance Bill was published, they deleted the cross reference (as Schedule 16 did get included in the shortened Finance Act 2017) but I guess no one checked what the previous amendment actually was and just assumed the previous wording was right. But no one cares.
