You have not said in your original post that your tax liabilities are as a result of being in a Scheme, be it EBT or Loan or anything else. In fact it sounds as if your tax problems are as a result of poor accounting, NOT tax avoidance.

The retrospective move against historic third party loans made to current or former employees before 9 December 2010 was unexpected and is likely to be difficult to enforce.
You are not alone. My settlement is declined by HMRC due to reason that they don't have authority to settle now! They mentioned that HMRC will know within next couple of weeks. Obviously this is HMRC so might take them years to act so figures crossed.
Are most people now looking to settle rather than wait to see what happens in April 2019 ?
I had 1 year on which they opened an enquiry and heard nothing for multiple years which I recently tried to settle on after a CLS but was declined and told I must now also consider settling on all my years of EBT regardless of whether an enquiry was opened or face paying the lot in April 2019. I could still pay for the year on enquiry but I would have to actively decline to pay for the other years in question where there was no enquiry.
I have held off not knowing how to proceed. If I have to pay for all years that is alot of money compared to try and get past this whole issue by just paying for 1 year.
Is there a general consensus on this form of what people think is best ? or what people are doing ?
