      Interesting read! but don't understand, where the scheme is registered under DOTAS, than what difference does it make whether the DOTAS SRN was added onto Tax return or not (as the scheme DOTAS is already registered with HMRC in the first place)?

        If you did not disclose the SRN on your return, then HMRC have basically no direct way to link you to the scheme, do they? (short of obtaining a list of scheme users by some shady methods, that is).

          Hence I believe that is why they have started sending out compliance check enquiry letters, to schemes either not referenced, or not believed to be required to under DOTAS. That must be the next target IMO and will probably bring GAAR into play !! Even worse !!!

            Probably looking in this a wrong way... but on the tax return the employer name is specified. This employer has has already registered with HMRC as a DOATAS. Are you telling me HMRC can't relate this employer as a DOTAS?

              In that particular case, maybe that is the case, but DOTAS schemes encompass much, much more than just employment intermediaries.

                  They definitely also got P11D with loans and employer details which registered the Dotas scheme. If they can find Dotas users for everything now sure they could have found it then

                    Totally agree!

                    This is why I think it dosen't matter whether the SRN is specified in the return or not, providing the scheme was registered.

                    This is why I find it difficult to understand that where SRN is specified, discovery is void!

                      They don't need shady methods. Whomever discloses may be required to supply a list of users.
