    No way out

    From all investigations, research, talking to experts it would appear there is no way out for anyone caught by HMRC. If so then you are one of the very few who will escape the executioner. They will enforce their claim, take your money and no matter what legal challenge comes at them from any group your money will forever remain in their coffers.
    Not even moving to Australia can save you as my friend has discovered. Reciprocal tax agreements.
    Whether morally correct or even legal, they will take us all down eventually and we will be forced to pay.

    The worst of it is that any tax benefit I may have 'allegedly' received all went west when I got divorced so I lose out twice.

    Not even sure divine intervention can help.
    No point delaying by 30 days or even more. They will have their pound of flesh from us in the end.

      If you are prepared to roll over and let them do as they wish then you are probably right.
      However, HMRC are not a law unto themselves, no matter how much they adopt their 'Spin' and 'Behaviour Management' tactics.
      They also have to adhere to the Rule of Law......or try to change it.

        You might have given up already, but for us out there the battle is only starting.
        (I am giving you the benefit of doubt and assuming you are of good faith and not yet another HMRC () troll)

          What utter tosh!

          If you have done some tax planning that a COURT has said doesn't work, then you pay the tax and interest and perhaps a penalty.

          If you pay an APN and later your liability is less, HMRC has no choice but to repay you.

          Perhaps your "experts" need to be a little more careful in explaining your options?

            So how can your liability be less later ? Surely you have the documentation, paperwork and if you engage an 'adviser' you are fully aware of your liability for the tax year in question.
            How can it change from what you calculate now ? If different then you can state this and enter in to a dispute with HMRC.

            Everyone has an idea on 'options' but no-one has an answer. Yes it may have been gloomy and I do not ever advocate giving up the fight. I will continue to battle them as I have done so in the past.

            However engaging an 'adviser' for ££££ can put you even further into the red for the same outcome.
            What options are there after the 90 days plus additional 30 ? Don't pay ? Litigate ?

            Are you saying there is an alternative to having to pay ?

              I'm afraid they are a law unto themselves Steve. If not then they will have the law altered, as they have done. I have fought them many times over the years. Sometimes I actually won. There is not a judicial person in the land that will rule against the HMRC and the government on this. They all want to to continue working, draw a fat pension and maybe cop a peerage.

              I certainly hope and pray there is a way to retain all we worked for. I have yet to meet anyone who says YES there is a way.

                  Most of your questions have been covered ad nauseum on the forum. I suggest that a hour reading some of the threads here would repay you.

                  As to "options", most advisers charge for their IP in identifying and executing those options and are unlikely to offer this sort of information for free.

                  No adviser worth their salt is going to guarantee a particular outcome and there is therefore a risk that, as you say, you will pay a fee and get little or nothing in return.

                      Incorrect. Whilst there's a reciprocal tax agreement in place, it does not extend to the collection of tax purportedly owed in one jurisdiction being collected in another jurisdiction. Rather, in the current environment it's viewed more as an 'information sharing' agreement between authorities.
