    1)used for 5 years only hit with last 2.
    2)used for 3 years, hit only for 1st and 3rd.
    3)used for 5 years hit with all 5.
    4)used for 3 years hit with first 2.

    Its all over the place.

      Is there anything legally that can be done on this point?

      That there appears to be inequality of approach taken or is it tough luck for some?

      Surely the HMRC have all users of these schemes or is it just HMRC are utterly chaotic in their approach taken?

      Lots of questions jump out the more thought I give this...

        You're correct - utterly chaotic.
        And there's nothing that can be done, it is actually just bad luck.

          If the situation is that HMRC has actively agreed certain years for certain schemes, rather than just through administrative incompetence failed to open an enquiry (and is therefore unable to issue an APN) then they may have created a "legitimate expectation" of a certain treatment.

          That's a tricky concept to prove and litigation history is littered with failed attempts.

          I'm afraid that in this case the likelihood is that the inconsistency is caused by administrative failing and there is little mileage in that.

            Hi, new to the group. Had a peek on a few threads but wondered if there was a dedicated group to those being pursued by HMRC in relation to Penfolds? If so, can you please point me in the right direction :-)

                Try advanced search(top right), search for Penfolds in all posts, view results as posts(rather than threads).

                Seem a few posters have been with Penfolds, maybe you could PM them?

                Note as you have less than 10 posts you will have to ask admin for PM rights.
