Android is open, all the source code is published by Google (http://source.android.com/) and there is a massive community of developers making use of it. I am currently running one such version on my Galaxy S3 (Paranoid Android for those interested) and it is now thankfully free of all the Samsung crapware.
What hinders the open source community is device manufacturers not releasing source code for the device drivers which they are supposed to do as part of the license agreement. This has been improving though and some manufacturers are even starting to release proper "unlocking" tools so that hardware that customers have paid for can be used for any purpose. Sony is case in point:
