Breaking News: Contractor wins 5½ year IR35 battle with HMRC
The judgment has been given today in the IR35 case of ECR Consulting – with another resounding victory for the taxpayer. Elaine Richardson, a self-employed IT contractor working through her own limited company for Vertex Data Science was facing an IR35 bill in excess of £50,000.
Elaine was represented by Accountax Consulting (via tax investigation insurance provided through membership of PCG), who successfully argued that not only did the essential characteristics of employment did not exist in the relationship, but Elaine was undoubtedly in business on her own account. Matt Boddington of Accountax reports: “What is particularly pleasing about this judgment is that the Tribunal had their commercial heads on and understood that contracting through a single person limited company is a prudent and sensible method of providing freelance services, and not about disguising employment.” The Tribunal found “it is clear to us that ECR us a genuine business and therefore not a target of the IR35 legislation”.
