Have been having a running battle with him for a few months, this week been off with a badly sprained ankle, and because I didn't ring in the day I went to the A&E, have been served 4wks notice.
Anybody had a similar incident? Any advice?

But I think you should reconsider your approach above. "He" like it or not, is the customer, the expression "The customer is always right" has hung around for a reason.
BTW, been there done that, and was glad to get away.

He stated 'If we can have you back like you were a few months ago, I would welcome you with open arms'.
So basically, not questioning anything he did.
