    You are almost never given automatic permission to appeal to a higher court. You have to ask that court to let you. I suspect that if asked the HoL will hear this, the issue is too complex for them to reject a request.

    As to getting the news quickly, somebody must know somebody who was at the court this morning.

    None of the 'normal' news channels appears to be reporting the result yet. I wonder if it will be on Working Lunch today?

      Unless the Appeal Court has refused leave to appeal (a decision that can itself be appealed), there is no way the House of Lords would refuse to hear the case. They only do that for vexatious appellants and although we might think HMCR are, the House of Lords don't.

        The HMRC just like the PCG will look at the judgement and see if they can find a reason to appeal.

        I fully expect them to appeal but now it is the HMRC that have the problem since the burden of proof is now on them.

                No, the case that just finished was the PCG appeal against the previous two (the original case at the commsioners that was a mis-managed joke by the presiding commisioner and the subsequent appeal which was also a joke by judge Park J).

                The next appeal will have to come from Hector, will have to be very carefully done (the current ruling is only one stop short of the House of Lords and is not to be trifled with lightly) and will take a year or two. Also if they then lose, any changes to the legislation or interpretation will have to come through Parliament, since these are taxation laws not rules.

                So a tentative three cheers, a small glass of sherry and a quiet celebration are entirely in order.
