Yet another unenforcible money maker that in practice will, as you say, be used against "soft targets". Surely the whole idea hinges on the smoker being seen to drop the fag? So they'll just drop them surreptitiously. Or flatly deny it was theirs, what then, does expensive DNA testing come into play?
