    eBay - how to get at a scumbag trader?

    Morning all,
    Looking for a way to get at a scumbag eBay trader.

    I bought what was advertised as a "Brand New and Boxed" pinball game for my youngest. Paid a fair price for it. It turned up in a shabby torn box, is scuffed and scratched and quite obviosuly used. It had what looks like floor underlay used as packing to fill out the box. Was going to be a brithday pressie.

    Have offerred to return it for a refund but got nowhere. Seller says don't bother going through ebay or paypal complaint channels as he will 'prove' it is new. Presumably his mate will provide the 'receipt'.

    Looks like I've been done by a chav who probably buys at bootsales and sells on. I will leave feedback, but that won't make me feel much better and he will put some note saying I'm wrong anyhow.

    Its not the money (about £40), its the principle. I hate people taking the P***

    So, any similar experiences? Any suggestions?

    if you are buying a present for someone you care about, don't buy it on ebay !

      take it thourgh ebay, complaine to them, but I think all they can do is remove his account, you could take it through the small claim court. how did you pay, paypal? complain to them..... I would not leave feedback yet....

        How much feedback does this person have ?

        Did you pay through Paypal ?

        Complain to Ebay. It will take ages but these type of things can be resolved.

        Leave neg feedback on the 90th day. (He/She will be unable to do so. on the 91st)

          Open a dispute through paypal and provide Photos of the product, get his to incriminate himself through email and use it as evidence in your claim.

          If he is a regular seller then register under another name, buy a few products from him and leave negative feedback a couple of days later.

          Check if he accepted returns, some do without knowing, send him it back recorded delivery and use that evidence in your claim.

            Take a photo so that you can proove is not new. Upload somewhere and put a link to it on his feedback and complain to ebay.

            Should only take a few minutes to do all that and it might stop him selling a few things which means he will have to create a new account etc. All very inconvenient and time consuming.

            But don’t put too much of your own time into it. It’s just not worth it.

                  Have just sent one last mail saying I will do the complaint thing and small claims court if neccessary. Not expecting a favourable reply.

                  What I really hate is the fact that they insult your intelligence. He thinks that by having a 'receipt' that 'shows' he bought a new one, proves that he sold me a new one. He thinks that threatening me with bad feedback will scare me off. I only have 2 feedbacks and couldn't give a feck.

                  When I complain will ebay give me his full name and address?
                  If not how will I be able to sue him?
