    This happened to a mate of mine.

    She even took him to the courts with a civil claim and got shed loads.

    The courts don't like motorists much.

      No, but I empathise based on experience. One dark and rainy night I was all set to reverse out from a line of parked cars. I double-checked and for some reason triple-checked back before reversing and on the third look, just as I was about to or was beginning moving, wouldn’t you know it an old woman had somehow appeared from nowhere since the last check and was standing right on my at my rear bumper. To say I was surprised would be a big understatement. Even when I was looking straight at her through misty wet rear window, she just a ghostly apparition and was nigh invisible.

        Yep. Once rammed from behind: people in front claimed whiplash. Once rammed from behind when stationary - car in front not insured, car in front of that therefore claimed all sorts of us. Once rammed in side by a drunk who tried to claim it was my fault that her passenger had no seat belt (???WTF???) because I was in their way.

        Do not deal with the individual at all. Forward all correspondence to your insurance company, it is what you pay them for. If the individual tries to contact you, tell them to speak to your insurance company.

        Let your insurance people sort it out. It's what you pay them for. They are also skilled and experienced in not paying out - much better than you are.

            New Zealand has ACC, so no personal sueing allowed

            Lawyers hate it, and our insurance permiums are about £100 per year.

              something similar happened to me...

              Driving to Stanstead at 5am at one of the roundabouts just before the airport - I was behind a car stopped at the roundabout - he moved off so did I and then he stopped abruptly and I hit him at about 2-3 miles an hour - broke his number plate and cracked my head light.

              I knew that this was 'my fault' so I asked what to do about it he said exchange insurance details - I said 'ok fine'

              Next thing I know he has put a claim in for 20 grand for whiplash!! And I was asked to testify as he wanted to sue me personally.

              3 months later - his cover was blown as during the time the claim was going on he was working for a budjet airline as a PILOT !!!

              I said to the insurance company - is it legal to fly a passenger plane with whiplash???

              never heard from him again - dodgy git.

                Tell her the insurance company lost her claim in the post, I'm sure she'll understand, after all it's just one of those things!
                The court heard Darren Upton had written a letter to Judge Sally Cahill QC saying he wasn’t “a typical inmate of prison”.

                But the judge said: “That simply demonstrates your arrogance continues. You are typical. Inmates of prison are people who are dishonest. You are a thoroughly dishonestly man motivated by your own selfish greed.”

                  Anybody had any experience with this - any recommendations etc???
