as a matter of interest does the new legislation cover lorry drivers who use CB radios ?

How about policemen driving at speed chasing crims and giving a running commentry at the same time, which requires them to press and hold a button on a walkie talkie/talking brooch.

AFAIK 2-way radios are exempt.

Emergency services are always except - I think you are also exempt if you are placing a call to the emergency services where it wouldn't have be possible/safe to stop.
