Hey Zam, for your own sake don't get depressed over this ! If it makes you feel better, talk to someone who can kick a few doors for you. It's WORK after all, not something that actually matters. If you want some perspective ask yourself who is going to care in 10 years time ? answer is no-one about virtually every bit of work you do.
Set the dogs on them, get a contract paying the same or more and move on.
Same as with a woman, only way to get over them is to get the next one, wine and crying is sod all use.

hi all, been in London all day, thanks for your posts especially you Cojack (I have PM'd you)

I also have had a fishing phone call from a previous colleague I worked with on a previous project, she was hinting if they offered me more money would I consider going back to that project ?? I am not sure if that was a real fishing question or if she was just saying this (all they know is I have started this new contract and not available, but they don't know about me getting the sack!) so may be there is an opportunity there for me.

I am actually a member of the PCG, but only been with them for a couple of months, I will try to call their legal help line tomorrow - thanks for the suggestion.

Denny, I have opted in, but you mentioned something re the gross miconduct clause in the contract, I still have that, I wasn't bothered about it because I never dreamt its going to be used against me, I always imagined gross misconduct means breaching confedentiality, or assulting someone. Do you think this is going to be still valid? Anyway will call the PCG and send them my contract to look at, I still haven't received any termination requests in writing, I asked the agency to send me this in writing stating the reasons for sacking me.

Gross misconduct for emailing the director to tell him what needs to be done?

They wouldn't have a leg to stand on.

Hope you are not too bored with this Saga, and update:

Just received a phone call from the person who asked me to send the email to the IT director, he was shocked as hell I was terminated, he insisted he knew nothing about it, and he also insisted that the IT director didn't have a clue about my termination, he or the IT director never complained about me. Hence the excuse that was given to the agency (me upsetting the IT director) was complete cr@p. This guy even sent me an email telling me he would like us to stay friends.

I know he could be bull$hiting me, however, I have an email in writing from him sent today commending me and wanting to keep in touch, he has no motive to do so, I am of no benefit to him any longer, hence I think he wrote to me because he genuinely thought I was a good worker. I am hoping this will convince the agency that I didn't do anything wrong and the client/then should pay me my notice.

I called the PCG, they recommended I write an invoice and a letter giving them 14 days to pay - I have done that for the 2 days already, and I believe they should pay that. I will see what they say about the notice though.

the plot thickens ! at least now you are able to provide evidence that no gross mis-coduct was committed

Denny, I don't believe that the agency is doing the screwing, must admit this agency is not bad at all, its the client who is doing the screwing. For whatever reason (there is a new programme director, and another workstream employed new staff to do more or less what I am supposed to do) hence they may have decided to cut down on staff, which I don't mind as long as they did it honourably and gave me the notice.

Sorry - had another update, I had a settlement offer from the client/agency that they are willing to pay me a 2 weeks notice now (after having a proof in writing from the director that he was not offended by email and in fact had nothing to do with my departure, never said anything about me) so they are offering to pay me for this week (which I worked 2 days already) and next week. Else I'd have to go legal against the agency, frankly the agency has been real good to me, so I am feeling bad about taking them to court etc, on the other hand am furious with the client for spreading lies and trying to ruin my reputation, I think they should pay for the full 4 weeks notice plus damages incurred to my emotional status. I will make the decision at the weekend the sum in question is around £4000 to £5000, so need to speak to legal to check what the best way going forward with this.

Anyway hope you people never go through this, but I if you do then I hope this story gives you a reason not to accept bullying and not to be a walk over to anyone. Fight for what's yours.

If you have writen proof, I think you should go legal and insist on the full 4 weeks pay, this will teach them not to mess around with contractors.

To be honest, I would take the money. You know you didnt do anything wrong, they know it, but this way, you get some moolah and a weeks hols and the agent has done the right thing.

                    Think of this as positive.

BTW, your last two posts offended me and CUK have decided to kick you off the site. Scotspine said you were nice though!

MF are you actually advising a contractor to settle for less than what he deserves?? what happened to assaulting the managers and leaving a dump on their desks.

Zam was not treated right and he needs to follow this up on principal, how do you feel if the client advertise for more contractors and you ended up working there? wouldn't you want to teach them a lesson so that they don't do this again?
