    Help! Company not paying me for days worked for them!

    Hi There,

    I recently undertook a contract with a very big UK corporation (will leave nameless for now!) and am very new to contracting so a little bit confused as to what to do next.

    They needed someone desperately and agreed up front to hire me for the month and review from there. I made it clear this would mean I'd need to cancel a couple of other contracts, but they agreed they'd use me for the month so that was no problem.

    After 13 working days, they had a change and no longer required my services. I received a PO for the full month (20 days) with instructions on how to invoice.

    After invoicing, quoting the PO, I was then emailed by the person who employed me, explaining that they were only prepared to pay me for "4 days". To quote the email explanation:

    "Although the total duration of you working with us was 13 days we can only pay for the time you spent doing [COMPANY] work. I’ve had a chat with [CONTACT NAME] to get his perspective on this and we think four days is reasonable compensation for the time you spent working with us and the output of what you produced."

    In my mind, there's a few problems here:
    1) They agreed up front they'd use me for a month (not written anywhere but I could possibly get them to accept this in an email)
    2) In the email above, they accepted I was working with them for 13 working days
    3) They only want to pay me for 4 days of that time because they had less work for me than they thought

    This was their mistake.. The fact they didn't need me was their problem and it appears I will lose out here big time

    Please can anyone provide me with advice on how to reply to the above email without sounding too angry? I'm very new to contracting and this is really becoming quite concerning to me!

    You are entitled to be paid for the work that you did. If you are on a daily rate, and worked for 13 days, then you bill that and they need to pay that. If you are on an hourly rate, then you bill for the hours and get paid those.

    If they are refusing to pay then follow the guidance on payontime.co.uk for chasing the bad debt.

    The question which may come up is what proof have you got that you worked for the 13 days?

    If they fail to pay, then sue them for the money in the small claims court.

      Can't believe a big company would operate like this, probably some little hitler trying to impress someone up the chain that he's responsible not wasting money. It'll come back to bite him/her when the dunning letters arrive.

        Thanks guys.

        Proof wise:
        1) Emails from them requesting things on 9 separate days including 1st and last day.
        2) Email from them confirming I "worked for them" for 13 days as quoted!!!

        They admitted they didn't need my services like they thought they would, but suggesting they pay me LESS for that is beyond scandalous.

        Once this is settled I'll reveal who (and may be in touch with journalists).

          As mentioned above, just follow legal procedure. You got enough proofs so far, but may get even more. Please also get clarifications from them regarding jobs done for the m (4 days) and jobs done for someone else - who was that someone else? If you got a contract with them along with PO - they will have to pay!
          Btw - are you contracted through an agency or directly? Did they signed time sheets for all 13 days?

                I meant if I end up having to go to court - If they resolve the situation then of course it would remain in confidence.

                It's a company in the public interest though. That's why I'm surprised I'm having to post on forums asking about legal advice due to them trying to get out of a commitment which has resulted in costing me potentially a full months earnings.

                    Thanks for that - The link looks good! Seeing as I was doing the work after the PO was sent, that would legally constitute as accepting the PO (along with sending the invoice)?

                    I'm glad they emailed confirming I've worked 13 days so far for them anyway - I don't see how they can seriously believe they can only pay me for 4 of that. They admitted to making a mistake so the fact they are trying to now use me to take the cost for that is insane.

                    Maybe someone is trying to save themselves at the company... All I can say is thank heavens for the internet and you guys! Feeling much better!
