Most contracts have a clause in them which says that if they don't get paid, you don't get paid.

As DaveB says, though, if you are opted into the agency regulations, then they have to pay you whether they get paid or not. So, if you didn't opt out of the agency regulations, in writing, before being introduced to the client then the agency have to pay you.

As others have said you need to look at your contract, technically whoever your contractual relationship is with is responsible for payment. Unless you have a "we pay when we get paid clause" included in the contract.

          XOR Professional Services in administration

I have been contracted by a UK branch of a US company via XOR and my payments are in great danger because XOR has gone into administration. If there are more people in this position, I would like to see what we can do. One thing I would like to have examinated is the responsibility of my end client, so the company that involved XOR for the timesheet and invoicing process (it didn't know them until the company that contracted me pushed them forward for the two projects I have been doing).

            XOR

I would advise everybody to have nothing to do with any future incarnations of XOR, I worked direct for them several months ago and they stalled when it came to paying, understandably as it transpires from speaking to the administrators that they knew they were going to the wall, and yet the directors were still milking the company. I've lost 5K, many will have lost more. They are crooks, and if they wish to sue me for libel, they are welcome to PM me for contact details. I will be very happy to oblige.
