    Already signed the contract with agency, client wants me to sign again

    Hi All,

    I recently renewed my contract with my agency. The client company has a new head of IP department. She insists I need sign another contract with them directly. Am I supposed to do that, sign two contracts, one with agency and one with the client?
    Also she imposed additional contractual conditions, i.e. working location, holidays/sickness which are not on the my original contract with the agency.

    What shall I do? Help!

    Speak to the agency, you shouldn't be having a contract direct with the client as well as the agency.
    Never has a man been heard to say on his death bed that he wishes he'd spent more time in the office.

      Politely suggest she discusses any contractual issues with the agent. I have no doubt that your contract with the agent forbids you entering into any additional contract with the client without their authority/agreement.

      What is 'IP'? Knowing that might help to understand what perspective she's coming from.

        Thanks for the quick responses.
        She just wants additional confidentiality assurances for the comany. Its for the intellectual property.

          This is permie employment contract stuff. Sounds like she doesn't understand contractors at all.

          As Scrag Meister said, talk to the agency directly about this. They should set the record straight on what they can and can't do when it comes to contractors.

              That's different. It's not a contract to supply services, which is what you signed with the agency, it is an agreement that you will keep confidential information confidential.

              It's common for clients to ask contractors to sign these. If possible, you should ask to sign a business to business orientated one (e.g. 7of9Limited agrees that confidential information from ClientCo... etc etc etc), rather than an employee related one, but it's not really going to make any difference tbh

              EDIT: This is only for the confidentiality agreement bit, I didn't read the rest of the OP properly

                On the client’s contract, she rewrote the Duties, Termination, location service occurs, and how many days I can be absent. She added additional contractual conditions which is a big red flag for me.

                    Empire building etc.

                    IP/Confidentiality/NDA's etc are quite standard but you definitely should question the other clauses.
