    Surely there is something that can be done about this. Limited Liability is designed to protect shareholders from a company failing, but directors can be pursued if it is shown that they haven't acted in the best interests of the company.

    I know that those who have lost money might be a bit short of cash right now, but you could club together and each stump of a few K as a fighting fund to go after Beckett and other responsible directors.

      the liquidators mentioned that this could be in the form of previous wages that had not been paid to himself therefore stored for the future and then taken as a lump sum but that seems very unlikely THAT man would withgo money, plus he would have not paid himself for the best part of 5 years for that sum. he also took a dividend out of 70k in addition to the directors remuneration.

      there are about 70 odd companies who money is owed too. not all of them will be bothered but for the larger sums it may well be worth contacting to form a legal group to challenge n.beckett who clearly hasnt acted in the best interests of the company and yes he can be held personally reliable.

          What happens next?

          Do the liquidators contact all the creditors or is up to us to contact them? Can i get a list of Creditors sent to me?

          I'm all for chipping in to get Beckett pursued for the cash

                ok for the sake of not all taking individual action but organising something collective, I suggest the list of action below:

                1) I will contact liquidators to understand how long the enquiry will take, how detailed the report will be and will we get to see it. Response will be pasted on here.

                2) I will scan the whole report anyone who would like a copy, please send me a private message (PM)with your email.

                3) I have another idea for raising awareness but need general consensus to go ahead with it, if interested please PM me, tell me your company name so I can check you are a legitimate creditor and I'll let you know.

                4) Depending on the results of the enquiry, if it feels like theres been any sort of whitewash, I think all main creditors owed over say £1000 should be contacted to see if they are interesting in pursuing legal action against the director say by a company like Gillhams who I have posted a link about before. Obviously this will cost money but seeing as there are at least 70 creditors, this could cost at lot loss less in legal fees amongst all of us. Anyone who would like to volunteer by helping to contact these creditors via email at first and informing them of intentions and this forum, please PM me.

                  If there's a case worth persuing wouldn't 'no win no fee' be an option?

                  If the legals want payment up front then wouldn't that suggest they know its a lost cause and are just looking to exploit the situation?

                    No win no fee tends to be for individuals not businesses.

                    Solicitors involved in large cases tend to want an initial payment up front then will charge you monthly. You have to remember they are businesses as well.
