    Contract termination

    Good evening

    I have been on my current contract,which is also my first, for a year now.

    There have been several changes within the clients organisation which are now resulting in proposed negative changes to my existing contract.

    As such, I am considering terminating my contract and wanted to confirm what the best way of wording such a termination would be and if submitting via email to the agency I contract via would be sufficient or if it needs to be in a formal letter.

    Also, upon reviewing my contract, the Termination clause is as below and I wanted to confirm that this means I need only give one working weeks notice.

    TIA.

    Termination of the Agreement
    The Employment Business may end this Agreement without liability for compensation with immediate effect on giving the Contractor notice in writing unless otherwise agreed in writing between the parties. The Agreement will continue for the duration of the Assignment, however in the event that the Client agrees with the Employment Business that the Contractor will continue to provide the Personnel to perform the Services to the Client after the End date set out on page 1 of this Schedule, and such agreement is reached no later than the End date, the Agreement will be deemed to continue indefinitely until such time that the Client ends the agreement without notice or the Contractor ends the agreement by giving 1 weeks written notice.

    Simple.

    Just write an e-mail to saying you'll finish on x date.

    No need to give a reason why.

      Have you got anything lined up to go to? If not I'd stick where you are until you get something. The market at the moment is horrible.
      Rule Number 1 - Assuming that you have a valid contract in place always try to get your poo onto your timesheet, provided that the timesheet is valid for your current contract and covers the period of time that you are billing for.

      I preferred version 1!

                i.e. the 1 week notice only applies if you've agreed to carry on providing staff to the client afterwards. In practice, this means the client can pay off the agency to take you direct, and then you can quit with 1 week notice. (at which point the agency says "har har!")

                ...I think. It's not exactly crystal.

                  That's not the way I read it but I agree, it's not exactly clear.

                  I think it's essentially trying to say three things:

                  - Client has zero notice period
                  - Contractor cannot give notice in the intial contract period
                  - After the initial period, the contract will continue until the client says it's finished - and now the contractor can now leave at one weeks notice.

                    Sounds like a week, I always request a summary page outlining key dates such as notice periods as well as a definition of terms etc.

                    As was mentioned the market is very bad at the moment, so I would make sure you have paid all returns and taxes and have enough money in the bank to live on for, I would say, at least a year before deciding to leave.

                    I had taken contracts for granted in the past and now, in the current climate, find myself in a very precarious position with a bank balance going from tens of thousands to almost zilch. Luckily I am in a contract right now (short term) and think I will manage to ride this out, but I would take heed.
