Normally a no go area, the client refuses to deal with you and the agency gets to find out and tell you they are not happy...

be very careful - a small business may be up for the idea but bigger companies have approved suppliers list's...

If the client is advertising the role elsewhere, then yes.
If not, then don't. It's best not to p**s the agency off.

It depends on how much you value the agency that refused to submit your CV to the client.
Have you obtained contracts before with this agency?
Would you like to do future business with this agency as they specialise in your area of expertise?

I have an idea who the agency is as it has happened to me in the past but
did not make the mistake of identifying the client.

If you answer no to the above questions I would phone one of the agencies
that I have worked for before and ask them to forward your CV. I would not go direct in this instant. Agencies get fees for introductions and the original one did not introduce you. Let another agency introduce you then its up to the two agencies to argue who introduced you to the client first. As the first agency did not submit your cv thats his problem
