Where can I get the facts about Opt-in contracts and handcuff clauses please?

    Hi all

First post - please be gentle!

Where can I get the facts about Opt-in contracts and handcuff clauses?

I am in a position where a former client has asked me to return (after an absence of some months) via their preferred supplier, for a short period. My previous contract for that client was with a different agency, wherein I had an opted-out contract with a 12-month handcuff clause.

To be with the client's preferred supplier could lead to much more 'direct' contract work going forward.

So, I would like to do this:

    1. Go back to the client with the 'old' agency for the short period offered (opted-in) - effectively honouring the handcuff clause but ensuring no future handcuffing because of the opted-in nature of the contract.
    2. Leave after this short engagement.
    3. If any future work for that client comes up, engage with that client via their preferred supplier, not needing to worry about handcuff clauses.

To be sure this will work I need to know the facts - is there anywhere I can find this info?

Many thanks for your help and insight.

    Cheers
    Bal
