Agent Asked me not to go in on Monday ?

Hi

The agent rang me on Friday afternoon saying that as the client owed them money I was not to 'go on site' on Monday.

My question is can an agent do this ?
Is it a breach of contract ?
and should I get it in writing before even considering not going in ?

The contract has two weeks to run and the notice period for termination (according to the contract is 4 weeks)

I believe the agent can, subject to the usual clauses in the contract. Remember, your contract is with the agent, not the client, and if the agent tells you not to go to the client and you do, don't be surprised if you don't get paid.

My agent phoned Friday evening, something that always scares me. Fortunately it was just a "how's it going?" chat/waste of my time.

My agent rung me a few weeks ago with "your finishing on the 5th aren't you".
"Well we have lots of jobs on the go ATM and if you send in a new CV we'll contact you with the suitable ones".

Sent in CV... and does he have lost of Jobs, and has he phoned to discuss them? No of course he hasn't (as I expected for the last 6 weeks of the year)

What's with this "must have the latest CV" lark when the only difference from the one that they already have is the job that they placed me in?

Yeah and you could probably write up a better remit than the one the agent was given prior to you starting the gig, hence "can you provide an updated CV"

Its not that there is no work its just that the clients a relatively large concern with a sluggish accounts department

I'd go in and discuss the situation with the client, preferably whoever is in charge of the client/agency stuff.

With only two weeks left, maybe the client has terminated the contract with the agency and they're trying to stop you getting your due notice period payment by concocting some other excuse.

I'd want to hear what the client has to say, never ever trust an agent when there's a way of getting another side to a story.
