    Agency IR35 form

    Got a mandatory form to sign with new contract that says:

    I hereby state that all my tax and national insurance contributions are being paid by my Umbrella/Limited Company in line with IR35.

    I understand that [Agency Name] are not responsible or liable for the ensuring of the above.
    Is this effectively declaring myself inside or just keeping them out of any potential investigation?

    There is no contract that is no liable to inspection, regardless of what is states and whether you sign or not.

    It's all about asses being covered......and they won't be too bothered about yours!

      Yeah I know it's them covering themeslves but my concern is that am I effectively declaring myself inside if I sign it?

      It's a 4 month gig where I'm being sent all over the country to roll out new machines to clientco offices - overnight, on my own, managing my own workload and stumping up for hotels/flights/trains etc.

      My concern is that if I sign it am I saying 'yes I am inside and will pay myself as such' or that all my tax and national insurance contributions are in line with IR35 which is how my Ltd/umbrella co sees fit? - what does in line with mean?

          Is it from GTS by any chance? The wording is exactly the same as what they sent me.

          I just ignored it and that was 6 months ago!

            Yes it is - the T&Cs are quite vicious as well, reading it makes me feel like I've just been banged up and I'm being told what the rules and daily routine are..

              Tell me about it... there’s one bit where it says you risk forfeiting pay if you send your time sheet in late, they sent me revised T's & C's with this included after I’d signed the contract.

              I argued that this wasn't even legal and quoted 'The Conduct of Employment Agencies and Employment Businesses Regulations 2003' act, they still wouldn't budge.

              In the end I agreed know they couldn't uphold this in a court of law, sometimes you need to bend over let them have their way just to keep the money coming in.

              Be warned they're very amateurish and don't seem to have a clue about client relations, they will effectively 'fine' you £35 for a late or incorrect invoice.
