There is some truth in that. But I'd still prefer to do it that way - pay direct and then let the agency sue for its 15% if it wants to - than put it all through the agency and risk its disappearance. -
WHS. Screw the agency and any shysters that try to muscle in - they went insolvent and owe him money!. Now he should make sure that he now gets the agents margin as well, to try to make up for the losses.Originally posted by thunderlizard View PostThere is some truth in that. That's-
Polaris Consulting Services Ltd.
Is this the Agency you dealt with DS23?
I'm not even going to reply to this new agency. It can only upset the apple cart as far as I'm concerned.Comment

But it's not just the 15% that the administrator could go after - potentially it's the whole lot, since the client should pay 100% (including agency commission) to the agency and then they pass on the rest to the contractor Ltd.Originally posted by thunderlizard View PostThere is some truth in that. IANAA and IANAL, but I'd be wary of going this route without knowing exactly what the potential consequences are for both the client and myself.
Mind you, I'd be claiming on my agency bankruptcy insurance by now, too...Comment

Surely though if the agreement was at Polaris' behest with all the legal documents etc to confirm that. The Administrator would not be able to pursue the client?
All the paperwork was signed off last month when Polaris still hoped they wouldn't have to go into Administration.Comment

Can anyone else employed via Polaris and reading this thread please drop me a 'PM. Just want to touch base and see what varying stories we've been told.Comment

I don't know - I'd speak to a lawyer sharpish before anyone gets burnt.Originally posted by mikeyboy View PostSurely though if the agreement was at Polaris' behest with all the legal documents etc to confirm that. The Administrator would not be able to pursue the client?

Just because the agency think that they are OK with the paperwork, doesn't mean that the receiver / administrator will see it the same way.
I'd ring the PCG legal helpline if you are a member. If not, then some house or car insurance policies come with legal advice lines that you can call. Better to be safe than sorry
