    Agency tie in periods

    After a bit of advice,

    Have just gone back to do some work for a client direct after previously being hired through one agency then sold on to another.

    I thought my original contract stated that I couldn't do any work for the second agency again for 12 months which is fair enough, however I've just noticed that the agreements includes " the clients client".

    In reality are the agency likely to enforce this as they have now found out I am back with the client.

    Just wondering if anyone's been in this situation before?
    Some people are like slinkys, totally pointless but the thought of pushing them down a flight of stairs never fails to put a smile on your face.

      Yea that works,

        Did you opt in / opt out (in writing before meeting the client).

        How long has it been since contract finished.

          12 months wouldn't stand up in court as it is too great a restriction. 3 months would stand up in court and 6 months is probably borderline.

          If you are opted in the clause is invalid.
