    Tax Lawyer Details

    I am in the mid of my investigation with TSM.

    Can you please provide me with the tax lawyer you are using?

    Please respond back to me as soon as you can.

    If anyone else knows of a good tax lawyer, please advise. me.

        TRM Investigation

        Hello everyone. It's the first time I have posted, I tend to steer clear of forums and bulletin boards. The fact that I have chosen to post is due to my growing concerns over my potential tax liabilities having used TRM since 2006. A recent letter from HMRC asking for details of my accounts from that time have done nothing to allay my concerns.
        Upon receipt of the letter from HMRC I contacted TRM for some guidance. The individual I spoke to was not surprised and could quote the contents of my letter verbatim without having seen it. This would indicate to me that along with other providers of EBTs, TRM/Batchworth/Payscheme +/ are coming in for particular scrutiny from HMRC as part of a focused investigation. Does anyone have confirmation of this?
        In approximately October 2008 I received an unsolicited letter from TRM offering me the opportunity to repay my outstanding loan up until that point. The story went something like "as the original loan was drawn down in Zimbabwian dollars" - "due to a benficial exchange rate etc". The net result being that I paid off the loan up to that point for a significantly reduced amount. Does this bear scrutiny? Has anyone else been offered or implemented something similar?
        I read patalista's post with interest. Is anyone actively coordinating a collective of like minded posters to employ legal representation as a group? I would certainly be interested.

        Any responses to my queries would be greatly appreciated.

            Hi Ive also been tapped by HMRC - I think they know that they cannot get TRM as they are offshore so are now using the bully-boy technique of getting the UK based employees, which unfortunately they are entitled to do.
            Therefore, we need to gather together as they will try to divide & conquer. It would be good to get details of that tax lawyer & all work collectively.

              I am currently seeking advice from a number of quarters. Some are independent ex tax inspectors previously involved in special investigations and also a firm of accountants based in Liverpool who have a good track record with such investigations. I am at the early stages at present and no one has discussed costs / likelihood of success etc as yet. I believe the best course of action is that of a collective with a unified front and significantly greater pooled resources.

              I will post my progress as things unfold.

                    Most of the people who have expressed interest in unified action cannot be PMed, I suspect it's because they are newbies.

                      We must be careful in any correspondence with HMRC, as innocent mistakes on our part will undoubtedly be used to our disadvantage. I'm also concerned about any precedents individuals may make, and HMRC's attempt to target us individually. This will be drawn out affair and most of us will have sleepless nights, which HMRC rely on for a favourable settlement.

                      Has anyone actually approached TRM / Batchworth about this request for information and what was their response. I think they should be managing all correspondence on our behalf, rather than leaving individuals to 'guess' the correct course of action.

                      Also some have approached Gilberts, so I'd fully expect them to have a handle on the situation. Can anybody feedback on their experience with Gilberts ?

                      We must be careful that any party acting on our behalf will not take us for a ride such that we end up paying legal fees on top of whatever HMRC deems appropriate.

                      So lets stop licking our wounds, and deal with this in a systemetic manner to minimise our liability.
