Right of Substitution - a few questions

folks, am in a situation where i'm considering exercising the right of substitution to go get another gig. (yes, i know the various pros/cons of bailing on a contract early, but am looking at options at present)

what advice do you give around the following;
- finding a substitute
- managing the agency with the substitute
- margin

if it all seems to hard, am inclined to stick with the current contract.

your thoughts, folks?

You really should find one by asking around friends and colleagues. The client is unlikely to accept someone that you can't personally recommend.

- managing the agency with the substitute

For a RoS to be valid, you continue to bill the agency paying the sub out of that.

- margin

Um, why should there be one? You're looking to place a sub so that you can break the contract. You should think yourself lucky if you get out even.

why no margin?

He's not breaking the contract, in fact the whole point of getting in a substitute is to make sure the contract continues.
There is still paperwork and possibly liability issues in the event that the substitute completely balls things up and the client wants to sue.
There is the possible problem of the substitute bailing out after 2 weeks after getting a better offer.

What might happen though is that the agency will be happier cancelling the contract and finding a replacement themselves rather than allowing you to exercise your right of substitution. (Or they and the client might suddenly get very picky about who they will allow to replace you)

hmmm... the insurance one is interesting, have to ask a few q's about that of my ins broker... (you see, these are the things i didn't think of! )

as for the bailing out and amongst colleagues, yeah, i'll have a sniff around and see what i can drum up.

I was making a serious point.

This board is (probably) as good as you are going to get. Going somewhere else is not likely to find you someone who can answer your question.

This tells me two things:

1) No-one on this board has done this (and very likely no-one knows someone who has)

2) Finding a sub is likely not going to be easy (hence my previous comment about not expecting to get a margin out of the deal).

I quite happy for you to prove me wrong on point 2, but I'm not expecting it to happen.
