Can this situation be deemed outside IR35

Hi all, long time reader, first time poster.

I am currently an employee of a company (company A) who provides onsite services to another company (company B). I have been working onsite at company B for 18 months now but have decided to move into contracting. I have given my notice at company A and finish up working on company B's site on friday, before heading into europe for 6 weeks holiday.

Company B have approached me to contract with them for 3 months when I return from my holiday. I am a little weary of this as I have been working onsite there for so long, albiet with employed with another company.

Will this situation be caught by IR35, or am I safe to cut out the middle man in company A and go direct.

Any advice would be appreciated.

IMHO: The gap makes it less likely (though no guarantees) that Hector will be able to easily show a "Finish on Friday, start on Monday" type of deal. Speak to a pro.

I don't think this is a mon-fri thing .. You were at company B as an external consultant (employed by company A) ..

Now, For company B, you will still be an external consultant (employed by Yourco, this time)


So, IR35 depends on the working relationship with the client ..

Moreover, IR will have no record of your previous relationship with Company B ..
