    Work Permit

    Simple question I hope.

    If contractor A comes over from Australia, and is engaged in a contract with bluechip B via his own Ltd co C, but his visa runs out in 3 months...

    Can A issue himself his own work permit through C, or does he have to bite the bullet and try to go permie with B?

    Can't see it being as easy as doing that, or everyone would be doing it!

      This is what I thought. There must be some catch, I'm suspecting you'd have to prove that no-one else (British) could do the job you're applying for, or you may have to have a number of employees to make it viable. Really wondering if anyone else has done this, and how.

          Hmm very interesting. But surely when you put forward the relevant documentation there will be something in there that will list you as the director of the company who is sponsoring the applicant, which is you...

            wouldn't this kind of be like IR35? that is, if you can provide your limited is as much a company as bluechip B, who can apply for a work permit, then so can your company? (after satisfying all the "couldn't find the skills here" stuff)

            (you can either go through all that, or just marry a pom! decisions, decisions...)

              It is illegal to run your own limited company on a work permit. You can only work as an employee of a sponsor.

                Is your Ltd Co registered here or Australia?

                I was under the distinct impression that to form a Ltd Co and Trade as that Limited company you had to be resident or a subsidiary of a multinational Co, not working under a temp work permit.
                Did you notify HMRC and Companies house that you were forming while on a temp work permit?

                I ask out of curiosity because this intrigues me

                  Possible Options

                  Hi,
                  I work for UK Work Permits Ltd. We noticed that this post generated some traffic for us so I thought I would post a response to try and help.

                  It is quite likely depending on the individual's earnings that the person who made the original post may be able to stay on in the UK working on the same contract through the Highly Skilled Migrant Programme. There is a points calculator for this on our website allowing anybody to check their eligibility in seconds.

                  Other options have been mentioned relating to the UK company being a branch or subsidiary of an overseas company, or servicing a contract between an overseas or a UK company. These areas can be fairly tricky and so I recommend calling us for advice. The HSMP route is usually the best option for those who qualify, as it is a more straight forward application process and the scheme offers complete freedom for the individual.

                  The HSMP is the most applicable route for most people wishing to work as self employed contractors or consultants.
