    IR35 and contractors

    i am an electrical control panel wirer machine tool electrician i have been ltd company for 4 mounths, first job lasted 2 weeks and took me 2.5 months to get paid. Contract at the moment pays every week no problem, i have been there 2 months and looks like going on a lot longer possable to the end of the year. Im i under ir35 i am on an hourly rate but not menthioned in invoice details,if they have no work i dont get paid.

    how long can i stay there, at the moment i have only taken wages no dividend and 40p a mile expences if i am under ir35 what changes !!

    also if i need extra help can that person go through my books ie let him sort his own tax out as a soletrader

    No way are you inside IR35 on what you have described here. You can stay there as long as you like but bear in mind the two year rule for claiming travelling expenses (your accountant can fill you in on this or a quick search of these forums will give you plenty of info).

    Your Ltd can do what it likes as regards hiring in help. Employees are a right pain in the ass though. The ideal would be another contractor working through his/her own Ltd. Failing that a sole trader, yes, but under certain circumstances you can end up liable for their tax if they don't pay it.
