Contract through a recruitment agency

    I've received a copy of the contract that I will have with the agency. It seems to fall squarely within IR35, which is a bit of a blow. The attractive contract is now not so much....

    Wish me luck getting that changed!

      Im in the fortunate position that I can walk away from contracts that dont meet my expectations. However, there's no point turning down money even if it is less than you normally work for if you're not in the same position.

      If \ when all these proposed changes come in, I'll have to decide whether to go back to retirement or work another couple of years for less.

        Hi there, sorry to jump in on the thread but im about to start my contracting career, until today i thought i will always invoice the client directly but will be in the same position as the originating poster.

        Financially is there any difference invoicing the agency instead of the client directly?

        Thanks and sorry to hijack the post, i didnt want to get terrorised for not searching !

          Before I answer your question a few points:
          1. Read the first timers guides - there are links on the right --->, or Google IPSE or SJD Accountancy as they have guides on their websites also.
          2. If you think of a question then use the search function OR use Google. To search on Google do it in the form:
          keywords site:http://site/domain/forum
          So if I wanted to look for tax:
          tax site:http://forums.contractoruk.com
          3. When you have done both but can't find the answer then and only then ask a question here stating what you found on your search.

          The first 2 points are due to the fact that loads of questions have been asked before and people won't be online to answer you immediately. The 3rd point is to stop you getting rude answers and regular posters ignoring your question.

          Your question is a fundamental of using agencies regardless of whether you are a contractor or a temp.

          If an agency finds you work unless they clearly state otherwise your contract is with them.

          If however you decide to use an umbrella company they are your employer legally. That means if you have a dispute with the agency you must ask the umbrella companies permission in writing to sort out the dispute yourself.

          If you use a limited company you will be an officer of that company so you will have permission to sort the dispute out.

              Yeah, but some of them are soooo funny it's worth it!

              I'll have to bear in mind what you've said about raising disputes with an agency if you're under an umbrella. Still wanting to know who Marky Mark's agency is and jealous of the OP - dealing with clients directly is my fantasy (deliberately open to mockery).

                  Right now I'm working for an end client with three intermediaries (if I include the umbrella). I know working direct for a client isn't necessarily trouble-free, but there is less red tape and I like simplicity. It took several conversations with agency and umbrella before I could figure out which of them I was actually working for from a legal perspective.
