Client no longer using my agency

    Client no longer using my agency

    I was working with agency AgencyA at ClientA, I left ClientA to go and work on a contract for ClientB through AgencyB.

    I now wish to return to ClientA (6 months later), however they are no longer doing business with AgencyA. If I now use AgencyC at ClientA will I be in breach of any 'loyalty/restraint of trade' clauses I previously had with AgencyA?

    I hope this makes sense.

    Any advice would be great.

        All perfectly clear. What does the contract say, and were you opted in to the Agency Regs?

            Makes no difference.

            Client refuses to use original agency so the original agency is losing nothing as they can't offer work at client, so contractor can't be in breach.
