That's rather defeatist. If you really want the role you'd fight for it. Surely clientco will respect you for that. If not, then I'd agree, best to move on.Originally posted by Scruff View PostYou haven't got the role, so accept the fact and move on?Comment

Agents lie to you, they lie to clients. Not all but the majority of them do. To be fair to them it's a hard job really as they are relying on commission all the time to earn a living so I don't blame them for behaving how they do sometimes.Originally posted by DTexas View PostDear all,
A general query here. In the last 2 years I have been lied to by agents. Even worse, they've lied to clients about me. On one occasion, I believe they were trying to sabotage my application as agent wanted to push his chum into the job instead. Maybe as his chum wanted less cash. Or maybe because he was his chum.
If it can be proven with email evidence that the agent has lied to clientco that I don't want the job anymore etc. can the agent get sacked and the job offer reinstated without the agent involved?
Contracting is also not fair a lot of the time. That's life so just accept it and move on.Comment

Not defeatist, but realist. OP hasn't got the role, and to get into a bunfight in what will ultimately be a Pyrrhic Victory is only going to cost him time and money?Originally posted by DTexas View PostThat's rather defeatist. Do you recall Frank's issue from a month back or so? We haven't heard back from him, IIRC?I was an IPSE Consultative Council Member, until the BoD abolished it. I am not an IPSE Member, since they have no longer have any relevance to me, as an IT Contractor. Read my lips...I recommend QDOS for ALL your Insurance requirements (Contact me for a referral code).Comment

Exactly how did you get this impression. What proof do you have?Originally posted by DTexas View PostYou get the impression they would rather have pushed someone else in for this.
They want some documentary evidence. You won't provide it -> there is no alternative on their side -> you are essentially withdrawing from the role.Comment

Always wondered about this. What details exactly can you get off them?Originally posted by Scruff View PostYou can also make a Freedom of Information request to get all your records from the Agent, unless I am mistaken?
Surely not confidential emails etc about their dealings with you/clients?Rhyddid i lofnod psychocandy!!!!Comment

Surely not for a SAR????Originally posted by DTexas View PostAgent's emails to screeners will be revealed by screeners SAR... I caught them by surprise.
So every single dodgy email that agency has lied to either party gets spewed up just because you've sent them a SAR? Cant see that happening otherwise every agent in the world would be screwed.
And after all if theres something well dodgy (quite possible with a lot of agents) they're not going to hold up their hands says "its a fair cop" and send you the incriminating evidence are they? They'll just delete it and/or pretend it never existed.
I might do it to my agent soon though. Be a laugh if it winds them up a bit anyway. :-)Rhyddid i lofnod psychocandy!!!!Comment

I suspect that the way round this is for the agency to argue that the correspondence relates to your company and not to you as an individual, so wouldn't need to be revealed by a subject access request.Originally posted by psychocandy View PostSurely not for a SAR????

I would also think that an email which says "Bob Smith has withdrawn from the role" would not be classed as personal data under the DPA.
If I'm wrong on both of those points (and I don't think I am), then deleting the emails isn't enough - they would have to show that they have been permanently removed from the live email system and are not held on any backups.Comment
