Misselling of contract

Hi,

Would appreciate your thoughts on my situation at the moment. I recently started a new contract and was told at interview that it would be for a specific project, I accepted as that is where my skill set lies. I realised when I started the job that I have been placed on a project that I have no experience in and did not originally apply for this particular role. I am also being paid the rate that I was going to get for the project that I applied for but the project that I have been placed on actually pays a higher rate than I am getting. How do I deal with this situation. Do I ask to be paid the rate that this project offers, do I say nothing, do I speak to the client or the agency? Its a confusing situation. I feel as though I have been missold a contract and taken advantage of. Is the agency pocketing the difference or is there some other reason....? Oh and even though I am trying my hardest to do my best, some of my work is being penalised. I find it really unfair that they are penalising my work when they knew I had no experience in this specific project yet they have placed me in it and now penalising me.

If the contract specifies the project that you are working on and the rate that you will get, then that is what you should be doing. Point out to the client and the agency that the contract needs to be reissued with the correct details on it.

The possibilities from there are:

a) the client and the agency refuse and you stay doing what you are doing at that rate;
b) the client and the agency refuse and terminate your contract for causing hassle;
c) the client and the agency modify the contract to have the correct project at the increased rate;
d) the client and the agency modify the contract to have the correct project at the current rate;
e) you don't bother because you are working at a rate you were happy to agree in the first place.

I suspect that some of those scenarios are more likely than the others.

Fair is where you go to ride the waltzers. This is business, and if you can't deliver what the client wants, expect to deal with it. That's business for you.

Maybe your negotiating skills aren't as good as the others.

You suck it up and do better so your work isnt 'penalised.' You're supposed to be a contractor now so just why do you think everyone should be paid the same rate? Too many new contractors think contracting is just permiedom with better pay.

If you dont like the situation you are in, you need to tell the agent your skillset doesnt fit the role and rather than bumble along being 'penalised' are going to terminate.
