      Pardon me for being stupid, but doesn't this seem to assume that a Ltd Co is either in our out of IR35, rather than it being judged on a contract by contract basis?

        Think it's saying that you have to declare one way or another and then if you say that you're outside they have their targets for the following year

          I think they are asking - historically at least - have you "**applied** (emphasis mine) the Intermediaries Legislation"; it always struck me that, although the intention of the question was obvious, you could quite maliciously answer it as "yes" in all cases - as in yes, I applied the legislation, but I found I was outside. Really shows how un thought through it all is.
