I think the problem is that proceedings are only generally brought on the instruction of the secretary of state as a result of the report from the insolvency practitioner.

I sent you a PM. I think he has to serve 50% of his sentence before parole. So that's 3 years. I'm guessing they will knock the period off he was on remand. Which was a couple of months I think. So he's done circa 8 months with a possible 28 to go i.e. he could be out in just under 2 1/2 years.

Will he breach the terms of his Parole, more than likely. There will ceratinly be many people waiting if he does.
The court heard Darren Upton had written a letter to Judge Sally Cahill QC saying he wasn’t “a typical inmate of prison”.

But the judge said: “That simply demonstrates your arrogance continues. You are typical. Inmates of prison are people who are dishonest. You are a thoroughly dishonestly man motivated by your own selfish greed.”

I thought this bit was startling:

In which case, why on earth was re re-admitted to ACCA?

The ACCA must have a case to answer here?

          Well found.

Agreed, how on earth did ACCA ever re-admit someone of this calibre? If I had suffered from his actions I would be looking into whether ACCA have some responsibility.

          I am appalled.

It seems you get banned 5 years at a time, so expect him ACCA approved sometime in 2016.

"The Committee ordered that Mr Upton be excluded from membership with
immediate effect and that no application for readmission to membership is to
be considered until the expiry of 5 years from the date of the hearing. Mr
Upton is to pay a fine of £10,000 and pay costs of £1,472"

If he was really determined to make a come-back then he could simply get someone else to serve as director in another company...

Why 14 years? Seems very low to me.

                      15 years is the maximum...so it's close!
