.Lobbying Campaign
A lobbying campaign has been launched to seek to get the retrospective element of S58 amended so the legislation only applies from the date it was announced in Budget Note 66 published on 12th March 2008.
A lobbying company has been appointed - The Whitehouse Consultancy | Specialists in public and parliamentary affairs
The main objectives of the campaign are:
1) to lobby for an amendment to S58
2) to assist promoters with Tax Tribunal appeals, Europe etc.
3) to instigate a formal complaint against HMRC's conduct as well as an ombudsman enquiry
4) to provide an information & support focal point for all victims of S58

All the main promoters Montpelier, Steed, deGraaf and PwC are now collaborating.
Tax Courts
It is likely that test cases will be heard at 1st-tier Tribunal late 2012/early 2013. Precise details of the grounds of appeal etc. have yet to be confirmed.
Europe
Steed applied to ECtHR in Strasbourg in January 2009. Their application is still in the system.
It is understood that enquiries are being made to see if Montpelier & PwC can be included in this application.
