People who joined the scheme in the beginning paid a 60/40 fee. 60% up front; 40% only payable if the scheme succeeded. The 40% is in effect treated as a loan. If Montp win in the end, then they would collect the outstanding fees.

Any idea when this structure changed?

I appreciate you may be spooked by this whole game of mischief but posts like these are not very helpful. If you don't know what the rules and processes are in bankruptcy then carry out some research and get some specialist advice. Perhaps your question should have been *where can I get specialist advice on bankruptcy"? Once you are declared bankrupt then your bankruptcy is handled by the Official Receiver, not HMRC.

Sorry if the post wasn't helpful. What I meant to say was that as a result of my research, my findings were as in my original post. What I was hoping for was a second opinion from others who had also done some research into potential bankruptcy and come up with different answers.

I know that accelerated payments are not the subject of this forum but if we are going to have to pay the tax quite soon which for many is about half what HMRC say we owe (due to interest) but it would probably be better to go bankrupt for the whole lot rather than try and deal with the accelerated payment and then go for the interest.

I really don't want to seem to be defeatist about all of this but I was in the scheme for 3 years from 2003 and have seen us pushed back several times so I think it makes sense to have a plan B.
