Interestingly, I just had this happen to me on a new contract opportunity. I'm wondering if its the same agency - ElanIT ???
They had pretty much the same clause which I baulked at. I basically explained that the client, a bank, had divisions across the UK and it was quite conceivable that I could contract through another agency for a role in one of those divisions. I said on that basis, it made no sense for me to pay a penalty on that. They even went one step further by stating that in the event of termination, they could withhold all outstanding fees as 'liquidated damages' to which I said 'no way, you pay for what you get'....
Sufficed to say that they are taking it under advisement.....we shall see what happens...
The point being is that many such clauses are just rediculous restraints of trade that shouldn't prevent you carrying on business of your own accord.Comment
