P35 Q6 & Q6b

So its that time of year again and Hector wants to know all manner of tax type details.

Having read extensively around the whole subject of how to answer P35 Q6 & 6b it seems that the clarity provided by HMRC means that we are pretty much forced to answer Q6 = Yes and Q6b = No (assuming that you're outside IR35).

This position is backed by PCG and Abbey Tax and to be honest I cannot see any argument for the majority to answer anything other than Yes & No. Leaves me feeling cold that Hector may pay me a visit very shortly however I guess if everyone answers Yes & No the plan may backfire...

Just wondered what everyone else has submitted / is planning to submit?

You're probably right with the sentiment re: Hector however the link you provide is to a post from April 2008. Hector issued revised guidance in September 2008 so pretty much everyone is going to have to answer Yes/No unless they are telling big fat porkies.

Which is the lesser of two evils? I'm going with Yes/No ultimately b'cos I drive myself and everyone else nuts with proving I'm not a deemed employee - IR35 disruptive madness at its finest.

Just make sure that what you answer on the P35 is consistent with your self assessment tax return in January where it asks how much has been earned from a service company.
