Client isn't paying - do I take the site down?

      I'd say 1 and 3. The only sensible action is legal threat to sue for the outstanding money.

      Of course, if the server is hosted in the US, then you can expect to be extradited for it.

        I'd take it down and wait for them to ring.

        Then tell them you'll sort it out when the account is brought up to date.

        What? Are they really going to call the rozzers, why would they?

        What are the police gonna say - it's a civil matter, they're not gonna know are they?

        We're talking real life here, not text book answers - the company just wants their website up, not a long winded court case.

          have you asked them to put it in writing the reasons why they will not pay?

          have you invoiced them? can't you just call up the accounts payables department and say the invoice is overdue?

          do you have a clause in your contract about payment terms and late payments?
          This default font is sooooooooooooo boring and so are short usernames

            Doing some more research (bored), it seems that a seller can include a "title of goods" clause when selling an item which means they retain ownership until payment has been made.

            Not sure this applies to retail stores though, but I've never read the smallprint on the back of the till receipt in detail, so who knows...

                Indeed, this is firmly on the criminal side of the fence...

                The level (or lack of) professionalism is astounding, you'd certainly jeopardise any future opportunities. If you have any professional memberships/qualifications you might like to read their codes of ethics too to determine how sparse your CV would look after doing something like that.

                    ok - the whole story is that they asked me to develop a set of .Net controls for their site (which I developed and designed in full). The site was almost done apart from these controls. So - I developed these controls and implemented them on the site.

                    Now - I could quite easily remove these controls from the site - the site would still work but would be missing some functionality. I could then say that I will reinstate these controls when I receive payment.

                    I know you guys would suggest that I go through a more professional/conventional approach but, through reasons I can't go into, this is time sensitive and there isn't enough time to go through any legal proceedings. Basically - there's potential that the company wont even exist in a month or so but the website will definitely be functioning for a good while yet.

                    It's only a month's pay that I'm missing which, while they are having cash flow issues, I'm sure they could scrape together.

                    I just want to get paid before Christmas.

                      If the company is that bad; your actions won't work.
                      Send a fax to them and ask them to pay up today or you will obtain a winding up order on Monday.
