I can see why the MPs malarky seems like a winner, but I so strongly believe 'greed' is the word of the day..... MPs, Bankers, IT consultants... 'burn them at the stake'...... thats the level of empathy we can expect.... remember people are in the tulip, losing jobs etc. etc. and they see people 'filling pockets'....... we are in this camp in their opinion
They don't care or understand the legals....... yes if you sit down and have a pint with Joe Bloggs explain the analogies he may come round.... but our channels don't permit that granularity or attention focus.... so its no use.
and so our date is set lets not lose focus on that, don't give up on FOI..... try and use the MPs issue but beware 'court of public opinion'....- SL -Comment

That's incredible. Given the total disregard HMRC has for its victims, this will ruin many peoples' lives. There'll be no need for retrospection, they don't even have to follow the law, just the law that might exist if they made it up? I find this even more offensive than retrospection, at least that can be fought in the courts. They will use this to destroy people, then walk away. I've seen a number of comments on shout99 about the retrospective elements of IR35. I didn't think it was retrospective. I know that new case law handed down by the courts can be interpreted retrospectively but isn't that normal in criminal law, and does not make the original legislation retrospecitve, as in BN66.

Code of Practice 8 allows them to open exploratory enquiries wherever they see fit. When they first opened enquiries into the MTM scheme, they didn't give any specific reasons or cite any laws that may have been infringed.
In any case, most tax avoidance arrangements these days have to be registered with HMRC before they can be used.
I think this story is more a case of HMRC trying to spell it out for thick tax inspectors what they should be looking for.Comment
