It took a while but the day has finally arrived - today really is our "day in Court". There are so many people on this thread that have tuned in for months and years and kept the faith that everything that they did was open, transparent and within the law as it was at the time it was done.
We told HMRC exactly what we were doing and how we were doing it. HMRC have had 7 or more years of opportunity to challenge our assertions of lawfulness but did nothing. They claimed it didn't work because of one case (Archer v Baker Shee) before eventually deciding that the law needed "clarifying" to ensure that another case "Padmore" fitted. They were going to take 4 cases to the Commissioners but didn't. Why do think that was then? Did their own Counsel tell them that they would lose perhaps.
Regardless of the outcome of the Hearing today, the underhandedness of the senior echelons of HMT and HMRC in this matter have and will contribute to lasting damage to a once great nation as a place to invest with certainty and confidence. Those in Government operate with the hand of deceit rather than trust. It needs to be rectified and our plight is a good place to start.
Seemingly its ok to spend inordinate amounts of money on people who cannot be bothered to work, or why not buy 270,000 of them a laptop for £1,100 so they can practice their eBay selling skills. It also seems to be ok to bankrupt and destroy the family lives of those that work and, in case anyone was unaware, pay taxes for the benefit of those others.
I look forward to catching up with a good number of you later on this morning. Remember, anything spent in the bar afterwards will not be available for HMRC if we eventually lose. However, today I expect to see our Counsel demonstrate to the Court that HMRC do not have a defense in law.
Its hard to get over the image of Santa tearing down Fleet Street in his sleigh to hit his lunchtime copy deadline.
